Alexander Barclay’s Estate and Final Settlement, A Summary!

Alexander Barclay died on 9 December, 1905 in Olmsted Co., Minnesota and his body was laid to rest in Farmington at the Corinthian Cemetery in Dakota County. Alexander’s tombstone is featured at Find A Grave.

A Summary of Alexander’s Estate

Alexander Barclay’s probate took from December 1906 to April of 1907.

My grandmother Grace A. McDonald petitioned the court to start the process of the probate but she was unable to continue because she was pregnant at the time. A Dr. Rogers was assigned to be administrator of Alexander’s estate process. There was no will so the estate had to be probated.  I refer you to the 2nd post in the list above for a review.

Here is a brief listing of the process in Alexander Barclay’s probate process:

1.  Petition for Administration of the estate and submitting of the heirs-at-law document.

2.  Setting of a Bond and granting of Administration to H.N. Rogers.

3.  Warrant to Appraisers and oath of the Appraisers.

4. Taking Inventory of the Estate which includes the personal possessions, land and other financials like stocks.

5.  Petition for License to Sell Real Estate.

Selling of Real Estate

6.  Publication of announcements in the local paper for the Creditors and hearing for claims against the estate and payment of those debts.  Printer’s Affidavit.

For Creditors

7.  In this case, affidavits from the children of the older brother John Barclay who was believed to be deceased were obtained, along with affidavits from other family members.

8.  Distribution of the stocks and transferring title to heirs.

9.  Final accounting and Petition for Settlement of the Estate.

Final Account

10.  Order discharging the Representative and releasing of the surety bond.

H. N. Rogers put an ad in the local newspaper in order to sell Alexander’s farm titled:

In the final account for Alexander Barclay’s estate eleven Receipt forms were filled out for each of the 11 heirs and signed by each one, so this means they had to be mailed, signed and returned. The siblings received approximately $548 plus 1/10 interest in the mining stocks.  Grace Barclay McDonald also received the larger sum.  For John Avery Barclay and Sarah Ellen Barclay they received about $273 plus 1/20 interest in the mining stocks.

The probate of Alexander Barclay has been extremely helpful in identifying the two families of John Barclay.  Unfortunately, it has not provided information about the origins of the Barclay family nor the mother Margaret of the first 7 children.

Studying the siblings has created more questions and an uncertainty of the actual ages of the children and their birth order.  John Barclay states he came to the United States in 1833 per his naturalization. After having studied the children of this man and learning of their viewpoints about the origins of the family, I think that a new approach is in order in searching for John Barclay’s origins.

This brings to a close the postings on Alexander Barclay’s estate. It is not the close of research which will continue.

In my opinion Alexander left a lasting legacy to his family.  I do know that George Barclay, his brother and my great grandfather, along with Grace, his niece and my grandmother, held him in esteem.

Minerva Parks Barclay Remarries…

Minerva Parks Barclay, after the disappearance of her husband John Barclay, remarried to Charles Buchwald on the 19th of June 1886 in Los Angeles, California.

I ponder what it might have been like for Minerva.  What happened, did John just disappear or did the marriage end, was there foul play and he was killed? At this point we do not know.

The following is taken from Wikipedia:

Several criteria affect declaring someone dead by assumption:

• A person’s being missing from their home or usual residence for, typically, seven years (the period varies from state to state)
• Such absences being continuous and without explanation
• Such absences being accompanied by a lack of long-distance communication with those most likely to hear from them
• Diligent but unsuccessful search for that person and inquiry into their whereabouts.

Apparently a missing person requires to be missing 7 years in California and it is called Presumption of death.  In the affidavits written by John, Ellen and Sarah Agnes Blinn they mention a diligent search was performed.  Boy would I love to know what that all meant.  I am assuming that the divorce Minerva obtained was probably “desertion.”

In any event, the John Barclay born about 1835-36 in Scotland, disappeared.  His wife Minerva Parks remarried and she lived the remainder of her life in California in the San Francisco area.  She died 30 June 1926 and is buried in Mt. Olivet Cemetery.  Find A Grave does not have her listed at this time.

Minerva is alone in the 1880 U.S. Census in Sonoma County, California where we find her with her two children, I have posted about this before but feel it is important to repeat it for consistency sake.

We move forward to 1900 and she is married and living with her family in San Francisco.  It looks like she had more children with Charles: Mable, Maggie and Godfrey however, she would be 43 years old when Mable was born?  The interesting part is the her mother, Louisa, is living with them.

It is interesting that John Barclay is with his mother and Violet is listed as a Buckwald, I thought she was John and Harriette’s child?  It seems I need to look for several divorces to learn what is happening with this family and do more digging.

Minerva Parks Barclay Buchwald died in 1926. The fate of Charles her husband is unknown at this time.

After studying all the information about John Barclay and Minerva Parks, and their two children John Avery and Sarah Ellen (Helen), I have to say it has been a challenge to find the documents and sources and make sense of the information because the information was not always consistent from source to source. There are so many questions yet to find answers to regarding this family and the descendants. I thank my cousin LeeAnn for her help and for sharing with me.

Heirs of Alexander Barclay: Helen (Sarah Ellen) Barclay Sears

Sarah Ellen, a daughter of Minerva Parks and John Barclay, became an heir of uncle Alexander Barclay after the affidavits about the status of her father, John Barclay, were submitted to the Probate Court of Dakota County.

Again the following is a mix of my research and my cousin’s.

Sarah Ellen Barclay was born the 29 March, 1869 in Sibley Co., Minnesota. She died on 16 August 1957 in Seattle, King Co., Washington as Helen Westerholme. She started using the name “Helen” by 1910.  At the time of Alexander Barclay’s probate process in 1906, she was known as Sarah Ellen Sears.

We find Helen Sears with Lewis Sears in the 1910 Census.

Unfortunately, tragedy struck and Lewis died 2 July 1913 in Seattle and is buried in the Mt. Pleasant Cemetery on Queen Anne Hill next to her brother John A. Barclay’s grave.  I have not found an obituary notice at this time for Lewis Sears but I did find a picture of a man who could be him but I cannot post here so below is the location of the article.

Years pasted and Helen, as she was calling herself now, remarried to Alex W. Westerholm on the 13th day of February, 1918, in Seattle, King Co., Washington. He may have been Axel rather than Alex.

Neither Helen (Sarah Ellen) nor John seemed to escape tragedy in their lives. Helen’s husband Axel was a Captain and his ship blew up.  An article about this accident at sea appeared in the Seattle Times Monday 24 April 1944 on page 7, column 2, 3 and more. The article also had pictures of the Capt and Mrs. Westerholm but I cannot share them here. What follows is only a portion of the article.

Families of Missing Straub People Still Hope for Return

Families of the seafaring men lost in the sinking of the Liberty ship John Straub last Wednesday today clung desperately to the hope that their men had reached shore safely or boarded ships nearby in Alaskan waters. Notified yesterday of the disaster, the wives and mothers telephoned each other and sought information additional to the meager accounts of survivors and Coast Guard officials.

Mrs. Axel W. Westerholm, 1718 14th Ave. S., wife of the 66 year old captain who has been going to sea with the Alaska Steamship Company since 1918, could not believe the veteran skipper could meet with a serious accident. “He was determined to keep going as long as vital cargoes were needed in distant parts,” she said.” He could have retired some years ago.”

First Trip on Straub:

Captain Westerholm, one of the Seattle’s oldest mariners in point of service, was in the vicinity of Dutch Harbor when the Japanese made their first raid at the outpost early in the summer of 1942. Although it was believed it was his first trip on the John Straub, he had been master of other Liberty ships and had served on passenger ships, freighters and cargo ships of all types…

The articles goes on to describe other men involved in the accident. There are other articles on the same page discussing the Liberty Ships and why they were in the waters in that location.

Helen Westerholm buried her brother John Avery Barclay at Mount Pleasant near her first husband Lewis Sears on Queen Anne Hill in Seattle, Washington in 1951.  She herself passed on 16 August 1957.

A funeral and obituary notice appeared in the Seattle Times on Sunday, August 18, 1957 for Helen:

Funeral: Westerholm – Helen S. 641 East 72nd, Mother of Raymond Steadman, Seattle. Private services Monday 11 a.m. Green Lake Funeral Home, Interment Evergreen. page 48, column 4. 

Obituary: Mrs. Alex W. Westerholm. Private funeral services for Mrs. Helen Sears Westerholm, 86, will be held tomorrow in the Green Lake Funeral Home. Burial will be in Evergreen. Mrs. Westerholm died Friday in a nursing home after a long illness. Mrs. Westerholm was born in Minnesota. She came to Seattle from California in 1912. She was a member of the Methodist Church. Mrs. Westerholm was the widow of Capt. Alex W. Westerholm master of the Liberty ship John Straub. He was killed when the ship exploded in Alaskan waters April 19, 1944. 

Mrs. Westerholm is survived by a son, Raymond A. Steadman, Seattle. 

UPDATE 2/21/2015:  Based on the information about Helen’s interment, I visited the Evergreen Washelli Cemetery and found her gravesite:

Here we finally see that Raymond Steadman was Helen’s son.  He has appeared in the census with Minerva mother of Helen as a boarder and grandson.  Who the father is unclear at this time and does this mean that Helen (Sarah Ellen) was married a 3rd time?

Raymond Steadman was born about 1889 in California and died on 24 January 1967 in Seattle, King Co., Washington in the Seattle Times Newspaper. Unfortunately it does not tell us about his parentage.

Obituary:  Raymond A. Steadman – Funeral services for Raymond A. Steadman 78, of 7018 Fifth Av. N.E. will be at 10:30 o’clock tomorrow in the Acacia Chapel, with burial in Acacia. He died yesterday in a hospital after a brief illness. Mr. Steadman came here from his native San Francisco 20 years ago. He owned and operated the Lake City Motel nine years, and also was an apartment house owner. His wife Lucille A. Steadman survives.

Update 2/21/2015:  Acacia Cemetery is very near so I visited it and found the gravesite for Raymond and Lucille.

Heirs of Alexander Barclay: John Avery Barclay

John Avery Barclay, a son of John Barclay and Minerva Parks and nephew to George and Alexander Barclay, submitted an affidavit to the Probate Court of Dakota County, Minnesota.  His sister and aunt also did the same. As a result John Avery Barclay became an heir to Alexander Barclay’s estate because his father John Barclay had disappeared years ago and was presumed dead.

What follows is a mix of my research and my cousins, a descendant of this man. I thank her for sharing.

John Avery Barclay was born 23 July 1867 in Sibley Co., Minnesota per my information. His death certificate has 3 June, 1866 as his birth date signed by the hospital where he passed. He died on 8 March 1951 in Seattle, King Co., Washington.

In the 1870 U.S. Federal Census John is with his father and mother in Sibley Co., Minnesota.  Please note the spelling of the name as Barkley.

Note:  Why they used the name Abraham I do not know? This census gives his age as 4 years old. This means he was born 1866?

The 1880 U.S. Federal Census has John with his mother and sister in Sonoma Co., California and there is no mention of John Barclay the father.

On 27 July 1889 John Avery Barclay married Harriette Louise Arcan in Santa Cruz, Santa Cruz Co., California.

Note:  Minerva Barclay, the mother, remarried to a Charles Buchwald on 19 June 1886 in Los Angeles, California.

Harriette was the daughter of Charles Edward Arcan who was born before 1849. She was born 22 December 1871 in Santa Cruz.  She died there on 21 December 1951.

Harriette Louise Barclay, a native of Santa Cruz and a member of the one of the early pioneer families died in San Francisco yesterday. Services are to be conducted tomorrow at 11:30 am from the mortuary of W.C. Lasswell and company, San Francisco, and interment is to take place at Mount Olivet Memorial Park. Mrs. Barclay’s grandfather was John B. Arcan, who was born in Versailles, France and lived in Montreal, Canada, before coming to the United States. He lived for a time in New York, then in 1849 came across country with a party organized in Chicago, taking the southern route, across Death Valley. They made their home in Santa Cruz, owning the corner where the Bank of American now stands. There they put up a building with a second floor room which was used for dances. Charles Edward Arcan, Mrs. Barclays father, was a baby when the party crossed Death Valley. Later he became prominent in Santa Cruz and was well known as an athlete and baseball player. Surviving Mrs. Barclay are her children, Charles, Ella Barclay and Mrs. Violet H. Stark, her grandchildren, Harry and Edward Stark and Edward Barclay and five great grandchildren.

John and Harriett had the following children:

1.  Violet Harriette Barclay, born 10 January 1890 in Santa Cruz and died on 14 September 1982 in California.  She married Edward Stark about 1909 and had two children. I have her in the 1900 and 1920 U.S. Census.

2.  Ella May Barclay born 7 January 1892 in San Francisco, California and died 1 March 1956 in California. She married a Becker after 1910 in California. She is featured in the 1900, 1910, 1920 and 1930 U.S. Federal Census.

3.  Charles John Barclay was born 7 May 1894 in San Francisco and died on 31 May 1975 in Hollister, San Benito, California.  He is found in the 1900, 1910, 1920 and 1930 census.

4. Edward Avery Barclay born 11 November 1896 in San Francisco, and died 24 July 1937 in California.  He married an Elsa MacPherson born 31 May 1905 in Butte, Montana and died 11 May 1978 in San Mateo, California. They had one son Edward Avery Barclay.  Edward married Alma E. Hardy and they had four children.  It is this family that my cousin is from and there are living descendants of this family who live on the West Coast.

John is buried in Mount Pleasant Cemetery on Queen Anne hill in Seattle, Washington.  He is next to the tombstone of Lewis Sears, a husband of his sister. These tombstones are in the section just left of the office building.

Of course, there is always more research that can be done on a family and I could look for more census, divorces, funeral home records and other documents.  At this time, I will move on and share about John’s sister Helen (Sarah Ellen) Barclay Sears Westerholme.

What happened to the Oldest Brother John Barclay?

In the last post I wrote about John Barclay the son of John and Margaret Barclay and brother to Alexander and George Barclay.

He took his family and headed to California about 1871-72.  They were probably there by 1874 when the baby son Albert passed.

Unfortunately the trail goes cold on John Barclay and what happened to him.

We turn to Alexander Barclay’s probate file and find several affidavits that may explain a little of what happened.  In any event, the estate of Alexander went to John and Minerva’s children:  John Avery Barclay and Sarah Ellen Barclay.

The two children, John and his sister prepare an affidavit that states what they know of the whereabouts of their father.

John Avery Barclay is the son’s name, but someone added, in handwriting on the original affidavits, an initial “A” in the father’s name to read “John A. Barclay.”

Apparently the court was not satisfied and wanted a third affidavit and in this case it was the sister of the said John Barclay who made statement.

Barclay, as the issue of said marriage, one son viz: John Avery Barclay, and one daughter viz:  Sarah Ellen Barclay, now Mrs. Lewis Sears.

             That said John A. Barclay, if living, would be 70 years of age, that he has not been heard from, and there is every reason to believe that he is dead.

             That his wife, Mrs. John Barclay, some time after the departure of said John A. Barclay obtained a divorce, and has since married again and is living in Sunnyside, California.

In 1880 there is a census record for Sonoma County, California where a Lulu Barkley is living there with a John and Ella, no John Barclay is listed with her.

This census information might have been easy to miss because of the reference to Wisconsin as the birth of the children.  My cousin has sharp eyes and knew who they were.

George and Alexander Barclay’s older brother John Barclay…

George Angus Barclay’s probate process was pretty easy for he had only two heirs: Amarilla, his wife, and Grace his daughter.

George’s brother Alexander didn’t marry although I suspect he did care about someone. Because Alexander remained single his heirs were his siblings and if deceased it would be their children.

In the last post I gave an overview of the eleven heirs of Alexander Barclay’s estate.  The heirs listed were the children of John Barclay and Margaret, the first marriage. and John Barclay and Ellen for the second marriage.  There would be full siblings and also half-siblings involved.  How close George or Alexander were to these other siblings I do not know.  Only a few attended John’s funeral according to his obituary. I have posted about John Barclay, the father, in this blog on many occasions if you want to review just do a search.

It is now time to share about the siblings.  I want to start with the oldest.

The oldest brother was named John Barclay.  I have his birth sometime around 1836. He may have been born earlier or later. In the census he is listed as born in Scotland.  John Barclay, the father, claims in his naturalization papers that he came to the U.S. in 1833. This would mean that the son was not born in Scotland but based on documentation you will see that this John Barclay was pretty clear about his birth country being Scotland.  This means that John Barclay the father gave the wrong information on his naturalization papers. Until this mystery of the Barclay arrival in the USA is solved the birth of the son John Barclay will be in question and for that matter all the children.

In  the post titled “John Barclay’s Two Families,” dated April 3, 2010 on this blog, I gave a summary of the children of John Barclay from each of the two marriages. In the next posts, I will share in more detail what I know about each of these individuals.

In my post “More Siblings in Connecticut 1850,” April 18, 2010 I did a study of the 1850 U.S. Connecticut census trying to identify the children of John and Margaret Barclay who were scattered around the Enfield.  The family of John and Margaret Barclay was scattered and broken in 1850.  A search of the census did not reveal John Barclay the father or anything about the mother who was said to have “died before the Civil War.” I do not pick up John’s trail till 1853 when he appears in Shakopee, Scott Co., Minnesota.  Where he was from 1833 to 1853 is not clear. The History of Enfield Connecticut reports about a John Barclay who was not paying his taxes and a Margaret who died in 1848.  There is not enough information to really prove that these are my ancestors.

John Barclay the oldest son has not been easy to find or to learn about.  I start with the 1850 U.S. Federal Census in Connecticut.

1850 Census: “A  John Bartley is living with the Olmstead family in Enfield.  The spelling is slightly different.  I have seen this spelling version of the Barclay surname before in other documents.  The family starts on line 9 with an Obadiah Olmstead age 34 male, farmer with $4000 in real estate, born in Connecticut.  He is followed by Hannah age 30, [Sauranu] age 7 female and Frederick age 4 male.  John is on line 13.  This John is 16 years old which means he was born about 1834 and born in Scotland.  John is followed by a James Boyle age 28 farmer, born in Ireland. 

This John Bartley is a strong possibility for the older brother of George and Alex.

In another post “1850 Connecticut – George and Alex,” dated April 11, 2010, I wrote about George and Alexander and the fact they were living in separate families as well.

I have spent some time trying to find out about apprenticeships in Connecticut  in the 1840’s and 1850’s.  Looking for poor houses in the area of Hartford County, Connecticut but the records are not good.  The towns would care for their poor and take families would take in children so there might be agreements but I have not had much success in finding them.  It has been frustrating.

By the 1857 Minnesota Territorial Census we find John Barclay, the father, living in Eagle Creek, Scott Co., Minnesota and George and Alexander are with him enumerated on 26 Sept 1857, by Frank Warren, pg. 326.

Line 21, 6/6 John Barclay, age 46, (born 1811) male, white, Place of birth – Scotland, naturalized, farmer. Line 22, 6/6 Alex Barclay, age 16, (1841) male, white, born in Conn. Line 23 George Barclay, age 14 (1843), male, white born in Conn.

There is no mention of John Barclay the oldest son in this census.  If I speculate, John Barclay would be 20-23 years old at this time and did he bring his two younger brothers to Minnesota or did they come by themselves. George would be about 13 years old and Alex would be 15 or 16 years old.  I have wondered how they got to Minnesota and thought it would be very interesting story.

In the General Index of Deeds for Sibley Co., Minnesota FHL#2294774, listed as grantee is a John Barckly.  He is buying from Grantor C.H. Drew, Recorded 12, Nov. 1858, Instrument dated 27, February 1858. Book C., pg. 557, W 1/3 of S1/3 of SE 1/4 of SE 1/4 Section 15, Twp. 112, R. 27. A copy of the deed would need to be obtained to see if it placed John in Sibley County or indicates he is listed somewhere else.

By the 1860 U.S. Federal Census we have John Barclay living in Kelso, Sibley Co., Minnesota.

In the year 1864 John is on the Delinquent Tax Lists for 1865-1875 for Kelso Twp., Sibley Co., Minnesota.

John Barclay appears in the 1865 Minnesota State Census in Sibley Co., Minnesota.  He is family #17, male. The date of the census was 1 June 1865.  (Roll MNSC-3).

He also appears on the Tax list for 1864.

From this information we know that Minerva was the daughter of Avery D. Parks and Lavisa (Lovina).  Minerva had siblings:  Allen (1852) Pascal (1854), Amy (1857), Iseral (1859).

Avery D.  Parks is also listed in the 1865 Minnesota State Census along with Louirie, Minerva, Allen, Pascal, Israel, Rhoda, Renaldo. Also a Miner R. Parks with Susan and Andrew follow as a family group. 

John and Minerva (Parks) Barclay had 4 children:

1.  John Avery Barclay (1867 to 1951). He will be featured in a future post and also his sister.

2. Sarah Ellen Barclay (1869 to 1957)

3. Albert Barclay (born 29 March 1870 died 24 August 1874) a twin.

4. Alice Barclay (born 29 March 1870 to ________) a twin

Albert died 24 Aug. 1874 in San Francisco, San Francisco Co., California according to funeral home records.

Unfortunately, troubles were still plaguing John Barclay in 1867 he gets arrested for allegedly stealing hay.

3. Sheriff Summons to arrest John Barkley for the stealing of 4 loads of hay, dated 6th day of Feb 1867 signed by the Justice of the Peace Eben. M. Gordon.

5. Formal printed with handwritting subpoena, dated 6 Feb. 1867, Eben. M. Gordon, Jof Peace for Sylvester Rice, A.D. Parkes, George Grant, Allen Parkes, Pascha Parkes.
6. Justice’s return – summary of the trial at the home of Sylvester Rice – John Barclay was convicted of stealing 4 loads of hay that was owned by David Adams. John Barkley to pay a fine of $30.00 by 9th day of Feb. and he will be imprisoned in the common jail of the county if the said fine is not paid. Signed 9th day of Feb by Mr. Gordon JP. Judge Austin decided that the court had not final jurisdiction and had John taken by the sheriff and he was to appear the 2nd of April 1867 in Henderson.
7. Court expenses listed total of $6.05 Feb 27, 1867.
8. Complaint of Daniel Adams that John Barkley had stolen 4 loads of hay from him Feb 6th 1867 and that John Barkley would be arrested. Signed by Mr. Gordon, JP.
9. List of the jurors: Wm. F. Barnes, Arnold Delger, Moses Peltier, H.C. Delger, Daniel McGuen, Oliver Peltier and witnesses Daniel Adams, Sylvester Rice, A.D. Parkes, Allen Parks and George Grant.

Grantor John Barclay and Wife, Grantee August Spannams, Instrument date 11 January 1871, Recorded 18 January, 1871. Book J/G pg. 536 – the NE1/4 Section 26, Twp. 112_28 & W1/2 S1/2 of SE 1/4 of SE 1/4, Section 15, Twp 112, R. 27, 170 acres. Copy not made.

There is a patent #1383, Application 1409, Issued 25 March 1872 in New Ulm to a John Barclay, NE, Sec 26, Twp. 112-N, Range 28-W, 5th Meridian, State MN, County Sibley.  MN1310_.261 BLM MN NO S/N.  Here is a link to his patent at the BLM:

Some time about 1871-1872 John Barclay left Sibley Co., Minnesota and headed to San Francisco with his family.

Note:  I cannot claim that I did all the research on this family.  My cousin a descendant of one of the children, John Avery Barclay, has provided me with clues and documents to aid in figuring out what happened to this family and I am grateful.
